Description:
Misdemeanor law is a whole series of legal regulations that prescribe misdemeanors and the sanctions provided for those misdemeanors. They include numerous laws from different areas of life. Misdemeanor law is a part of the public law of a certain state (lat. ius publicum), the public law through which that state exercises its right to punish offenders (lat. jus puniendi). Misdemeanors, along with criminal offenses and disciplinary offences, are only one of the types of punishable actions in the criminal justice system.
The subject contains institutes related to substantive misdemeanor law, . misdemeanor, guilt, misdemeanor sanctions and their application, confiscation of property benefits, confiscation of objects, rehabilitation, based on the principles of misdemeanor procedure, preliminary question, jurisdiction of courts, institute of exemption, subjects of misdemeanor law, submissions, minutes and viewing of files, delivery,
deadlines and restoration to the previous state, measures to ensure the presence of the defendant, costs of misdemeanor proceedings, investigations of misdemeanors and collection of evidence in enforcement
supervision, misdemeanor proceedings in the first instance, course of proceedings, judgments and types, misdemeanor proceedings before state administration bodies, appeal, extraordinary legal remedies,
special procedures-urgent procedure and procedure before a minor offender, misdemeanor order, mandatory misdemeanor order, collection of a fine at the place of commission
misdemeanors, execution of decisions on misdemeanors and execution of protective measures, procedure for execution of work for the common good, procedure for execution of a foreign court decision. The most important laws that students will learn about:
- Law on road traffic safety
- Law on offenses against public order and peace
- Law on protection against domestic violence
- Law on the Prevention of Disorders at Sports Competitions
Learning outcomes:
  1. explain the concept of misdemeanor law and its relationship to other legal branches and the relationship between misdemeanors and other punishable acts;
  2. - understand and explain the basic institutes of misdemeanor law and procedure (types of misdemeanor sanctions, mandatory misdemeanor order, etc.);
  3. - interpret the terms of the general part of misdemeanor law and procedure, the characteristics of individual misdemeanors and the content of individual procedural actions in misdemeanor proceedings;
  4. - apply the acquired knowledge from the general and special part of misdemeanor law in practice;
  5. - to compare the Croatian misdemeanor legal system with the misdemeanor legal systems of other countries and to examine its compliance with the law of the European Union;
  6. -         analyze the existing court practice in the segment of misdemeanor law.
  7. -          evaluate the quality, sustainability and enforceability of legal and theoretical institutes of misdemeanor law in practical conditions;
  8. -         evaluate the national misdemeanor legal system from the aspect of constitutional and international law.
